These Terms of Use (“Terms”) govern your use of www.jonnasmarket.com (the “Site”), operated by Jonna’s Market (“Jonna’s,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Use of the Site

You may use the Site for personal, non-commercial purposes. You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, scraping it by automated means, or using it for any unlawful purpose.

Products, Prices & Availability

Information on the Site — including menus, products, specials, prices, promotions, and hours — is provided for general information and may change at any time without notice. Prices and availability may differ between our Howell and Brighton locations and between in-store and online orders. Photos are for illustration only. We are not responsible for typographical errors, and we reserve the right to correct errors and to limit quantities.

Online Ordering & Delivery

Online orders, catering orders, and payments are processed by third parties such as Toast, DoorDash, and Grubhub. Those orders are subject to the third party’s terms and policies in addition to these Terms. Order times, fees, and delivery are handled by those providers.

Alcohol & Age-Restricted Products

Beer, wine, spirits, and other age-restricted products are sold only to customers who are of legal age under Michigan law (21 or older for alcohol). Valid government-issued photo identification is required at pickup or delivery. We reserve the right to refuse any sale. Please drink responsibly.

Allergens & Food Safety

Our store prepares and handles foods that contain or may come into contact with common allergens, including milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soy, and sesame. We cannot guarantee that any item is free of allergens. Ingredient and nutrition information on the Site may be incomplete. If you have a food allergy or dietary restriction, please ask a team member before purchasing. Consuming raw or undercooked meats, poultry, seafood, shellfish, or eggs may increase your risk of foodborne illness.

Intellectual Property

The Jonna’s Market name, logo, photos, graphics, text, and other content on the Site are owned by or licensed to Jonna’s Market and are protected by copyright and trademark laws. You may not copy, reproduce, or use them without our written permission.

Third-Party Links

The Site contains links to third-party websites and services (such as ordering, delivery, maps, and social media). We do not control and are not responsible for their content, policies, or practices.

Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JONNA’S MARKET AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Jonna’s Market from any claims, losses, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Livingston County, Michigan, and you consent to their jurisdiction.

We may update these Terms at any time. Changes take effect when posted, and your continued use of the Site means you accept the updated Terms. Our Privacy Policy also applies to your use of the Site.
